1. Eligibility

To use Tasty Bot Tastic you must be:

  1. At least 18 years of age;
  2. A legal resident or citizen of the United States (or a jurisdiction where automated options trading services are lawful);
  3. The holder of a valid, individually owned brokerage account in good standing with tastytrade, Inc.; and
  4. Legally permitted to trade options and/or futures in your jurisdiction.

By using our services you represent and warrant that all of the above are true. We reserve the right to suspend or terminate accounts that do not meet these requirements.

2. General Risk Disclosure

Options and futures trading involves substantial risk of loss and is not suitable for all investors. You may lose all or more than your initial investment. Only use risk capital — funds you can afford to lose without affecting your financial security or lifestyle. Carefully consider your experience level, investment objectives, financial resources, and risk tolerance before using any automated trading tool.

UNDEFINED AND UNLIMITED RISK

Certain strategies available on this platform, including but not limited to the ES 45DTE Naked Put and the ES 120DTE Put Ladder, involve selling options without a fully offsetting long hedge. These strategies carry theoretically unlimited or very large maximum loss potential. The ES Naked Put strategy holds a short put with no long leg; losses grow $50 per point per contract with no floor. The ES 120DTE Put Ladder carries net short exposure below its far strike; losses grow at the same rate with no defined maximum. Users enabling these strategies in live accounts must understand and accept this risk explicitly.

Past performance — whether from backtests, paper trading, or prior live results — is not indicative of future results.

3. Nature of Our Services — Not Investment Advice

Tasty Bot Tastic provides a technology platform, automated execution bots, and tools that help users implement their own options and futures trading strategies. We do not provide investment advice, financial advice, trading recommendations, signals, research, or analysis of any kind.

All trading decisions, strategy selection, bot configuration, parameter settings, position sizing, and risk management are solely your responsibility. Our bots execute pre-programmed rules and parameters that you define, enable, and control.

Tasty Bot Tastic is not a registered investment advisor, commodity trading advisor (CTA), commodity pool operator (CPO), broker-dealer, or financial institution. Nothing on this platform, in our documentation, in strategy descriptions, or in any communications from us constitutes investment advice or a recommendation to buy or sell any security, futures contract, or option.

4. Automated Trading and Bot-Specific Risks

Automated options trading carries unique risks beyond those of manual trading:

Technology and Execution Risks

Bugs, software defects, API changes, connectivity failures, server outages, latency, slippage, or data feed interruptions may cause missed trades, incorrect executions, duplicate orders, or unintended open positions. Market volatility can significantly exacerbate these issues.

Strategy and Configuration Risks

Bots rely entirely on rules and parameters you configure. Poorly tested configurations, changing market conditions, unexpected volatility events, or parameter errors can result in significant losses. Backtested or simulated results do not guarantee live trading performance.

Monitoring Requirement

You must actively monitor all open positions, running bots, and brokerage accounts at all times. Automation does not eliminate the need for human oversight. Do not leave bots running unattended for extended periods without reviewing account status and open positions.

Third-Party Dependencies

Our platform integrates with tastytrade, Inc. and market data providers. Outages, API changes, or policy changes by these third parties are outside our control and may impact bot operation without notice.

Paper Trading Limitations

Paper trading uses real market prices for simulation but does not involve real capital, real order routing, or real fills. Paper trading results may differ materially from live trading results due to differences in fill quality, slippage, liquidity, and execution timing.

By using our services, you acknowledge these risks and agree that Tasty Bot Tastic bears no liability for losses arising from them.

5. TBT AI Rank Disclaimer

The TBT AI Rank is a proprietary composite scoring metric developed by Tasty Bot Tastic. It is calculated from historical backtest data using Sharpe ratio, Sortino ratio, and Calmar ratio components, and is intended solely for comparative and educational purposes.

The TBT AI Rank is NOT:

  • A regulatory rating or certification of any kind
  • A guarantee or prediction of future performance
  • A recommendation to use or avoid any strategy
  • An endorsement by any regulatory body or financial institution

A high TBT AI Rank reflects favorable historical risk-adjusted metrics under the tested conditions only. Market conditions change, and past backtest performance does not guarantee future results.

6. Custom Bot Development Service

Tasty Bot Tastic offers a custom bot development service whereby we build automated execution software based on trading rules, parameters, and logic submitted by the subscriber ("Custom Strategy").

By engaging this service, you acknowledge and agree that:

  1. Tasty Bot Tastic is providing software engineering services only. We do not review, evaluate, validate, endorse, or offer any opinion on whether a Custom Strategy is sound, profitable, or suitable for any purpose.
  2. The Custom Strategy logic is provided entirely by you. You are solely responsible for its design, testing, and live deployment.
  3. TBT AI optimization of Custom Strategy parameters is a mathematical analysis of historical data only and does not constitute investment advice or guarantee future performance.
  4. Custom bots are private to your account and will not be made available to other users without your explicit written consent.
  5. Custom bot development fees are non-refundable once development has commenced, regardless of strategy performance.

7. Relationship with tastytrade®

Tasty Bot Tastic is an independent software platform. We are not owned by, affiliated with, endorsed by, or a subsidiary of tastytrade, Inc.

tastytrade® is a registered trademark of tastytrade, Inc. All rights reserved by tastytrade, Inc. The use of the tastytrade® name on this platform refers solely to the brokerage service with which Tasty Bot Tastic integrates and does not imply any business relationship, partnership, or endorsement between Tasty Bot Tastic and tastytrade, Inc.

Users must independently agree to tastytrade's own Terms of Service, Customer Agreement, and Risk Disclosures. Your brokerage relationship is solely between you and tastytrade, Inc. Tasty Bot Tastic has no access to, control over, or liability for your brokerage account, funds, or positions held at tastytrade.

8. Account Credentials and Security

To connect our platform to your tastytrade® brokerage account, you will provide authentication credentials (including but not limited to username, password, and/or API tokens). You are solely responsible for:

  1. Maintaining the confidentiality and security of your credentials;
  2. All trading activity that occurs through your account, whether or not authorized by you; and
  3. Immediately notifying us and tastytrade if you believe your credentials have been compromised.

Tasty Bot Tastic employs reasonable security measures but cannot guarantee the security of credentials or data transmitted over the internet. We are not liable for losses resulting from unauthorized account access due to credential compromise, phishing, or other security incidents outside our direct control.

9. Hypothetical Performance & CFTC Rule 4.41

Performance figures, backtest results, strategy statistics, and TBT AI Rank scores presented on this platform may be based on hypothetical or simulated trading results.

Required CFTC Disclosure (Rule 4.41)

HYPOTHETICAL OR SIMULATED PERFORMANCE RESULTS HAVE CERTAIN LIMITATIONS. UNLIKE AN ACTUAL PERFORMANCE RECORD, SIMULATED RESULTS DO NOT REPRESENT ACTUAL TRADING. ALSO, SINCE THE TRADES HAVE NOT BEEN EXECUTED, THE RESULTS MAY HAVE UNDER- OR OVER-COMPENSATED FOR THE IMPACT, IF ANY, OF CERTAIN MARKET FACTORS, SUCH AS LACK OF LIQUIDITY. SIMULATED TRADING PROGRAMS IN GENERAL ARE ALSO SUBJECT TO THE FACT THAT THEY ARE DESIGNED WITH THE BENEFIT OF HINDSIGHT. NO REPRESENTATION IS BEING MADE THAT ANY ACCOUNT WILL OR IS LIKELY TO ACHIEVE PROFIT OR LOSSES SIMILAR TO THOSE SHOWN.

Backtested results presented on this platform used historical SPX 5-minute tick data from 2022 and 2023. These years were selected to span a bear market (2022) and a bull market (2023) as a cross-regime stress test. They do not cover all possible market conditions. Results do not account for all commissions, fees, slippage, or taxes applicable to live trading.

Testimonials or user performance examples, if shown, are not representative of all users and do not guarantee similar results. Please review the OCC's "Characteristics and Risks of Standardized Options" publication before trading options. Futures accounts are not protected by SIPC.

10. No Warranties; "As-Is" Provision

Our platform, bots, strategy descriptions, tools, and all related content are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement.

We do not warrant or guarantee:

  • Uninterrupted or error-free operation of the platform or bots
  • The accuracy or completeness of market data or strategy descriptions
  • That any strategy will be profitable or meet your investment objectives
  • That the platform will be available at any particular time

11. Limitation of Liability and Indemnification

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TASTY BOT TASTIC, ITS OWNERS, OFFICERS, EMPLOYEES, AFFILIATES, AND AGENTS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES (INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, TRADING CAPITAL, DATA, OR BUSINESS OPPORTUNITY) ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE OUR SERVICES, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE TOTAL SUBSCRIPTION FEES PAID BY YOU TO TASTY BOT TASTIC IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Indemnification: You agree to indemnify, defend, and hold harmless Tasty Bot Tastic and its owners, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the services; (b) your trading activities; (c) your violation of these Terms; (d) your Custom Strategy submissions; or (e) any third-party claims resulting from your actions on the platform.

12. Subscription Terms

Billing

Subscription fees are billed in advance on a monthly or annual basis. Annual subscribers receive a discounted rate. Fees are charged to your payment method on file at the start of each billing period.

Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused portions of a billing period.

Refunds

Subscription fees are non-refundable except as required by applicable law or at our sole discretion in cases of documented technical failure attributable solely to Tasty Bot Tastic.

Service Availability

We strive for high availability but do not guarantee any specific uptime SLA. Scheduled and unscheduled maintenance may temporarily interrupt service. Downtime does not entitle users to refunds or credits unless separately agreed in writing.

Account Termination

We reserve the right to suspend or terminate accounts for violation of these terms, abusive behavior, fraud, or for any other reason at our sole discretion with reasonable notice where practicable.

13. Governing Law and Dispute Resolution

These Terms and any disputes arising from your use of Tasty Bot Tastic shall be governed by the laws of the State of Louisiana, without regard to its conflict of law provisions.

Any dispute that cannot be resolved informally shall be submitted to binding arbitration under the rules of the American Arbitration Association (AAA), conducted in Oakdale, LA. Each party shall bear its own attorneys' fees unless the arbitrator determines otherwise. You waive any right to participate in a class action lawsuit or class-wide arbitration against Tasty Bot Tastic.

14. Changes to These Terms

We may update these Terms at any time. We will notify active subscribers of material changes by email or in-platform notification at least 14 days before the change takes effect. Continued use of the platform after the effective date of any update constitutes your acceptance of the revised terms. It is your responsibility to review these Terms periodically.

15. Consult a Professional

Nothing in these Terms or on the Tasty Bot Tastic platform should be construed as legal, financial, or tax advice. We strongly encourage you to consult a qualified financial advisor, licensed CTA, and/or tax professional before engaging in options or futures trading.

By using Tasty Bot Tastic, you voluntarily assume all risks described herein and release Tasty Bot Tastic from liability as set forth above.
